It runs 15 checks for loan and credit ads, based on the RBI (Digital Lending) Directions, 2025 dated 8 May 2025 and the RBI Responsible Business Conduct Second Amendment Directions, 2026 dated 15 Jun 2026, and 14 checks for SEBI-registered investment adviser and research analyst ads, based on SEBI circular SEBI/HO/MIRSD/MIRSD-PoD-2/P/CIR/2023/51 dated 5 Apr 2023. RBI issued the Responsible Business Conduct Second Amendment Directions on 15 Jun 2026 and they come into effect on 1 Jan 2027. They ban dark patterns such as false urgency, drip pricing and disguised advertisements, require interest rates and fees in promotional material, and allow promotional messages only to customers who gave explicit consent.
Annex III of the RBI Responsible Business Conduct Second Amendment Directions, 2026 lists 11 dark patterns: false urgency, basket sneaking, confirm shaming, forced action, subscription trap, interface interference, bait and switch, drip pricing, disguised advertisement, nagging and trick wording. The list is illustrative, and the CCPA 2023 dark pattern guidelines also apply.
Under the SEBI advertisement code effective 1 May 2023, the ad must show the name as registered with SEBI, registered office address and registration number, carry the standard market risk warning word for word in at least 10 font size in print, include the disclaimer that registration and certification do not guarantee performance, and have prior approval from the SEBI-recognised supervisory body. It must not promise returns, cite past performance or use the SEBI logo.
